General Terms and Conditions (Allgemeine Geschäftsbedingungen - AGB)

​1. Introduction

Welcome to Firebird Pilates.  These Terms & Conditions ("Terms") govern your use of our services, website/App, and participation in our Pilates sessions, whether in person or online. By accessing our website/App, booking a session, or attending a class, you agree to abide by these Terms.  

​Firebird Pilates operates in compliance with German law, including the German Civil Code (BGB), the Fair Consumer Contracts Act (Gesetz für faire Verbraucherverträge), GDPR, consumer rights, and health and safety regulations. If you do not agree with any part of these terms, you should not use our services.  

​2. Booking & Payments

​Session Booking: All sessions must be booked in advance through the Firebird Pilates Website/App.

​Payment Policy: Payment is required at the time of booking. Sessions are not confirmed until full payment has been received. We accept payments via the Firebird Pilates Website/App. All payments are processed securely by booking platform (Trainin.de) and their regulated third-party payment processor Mollie, and Firebird Pilates does not store credit card information.  

​Pricing & Schedule changes: Prices and class schedule are listed on the Firebird Pilates Website/App and may be subject to change.

3. Products 

• Single Reformer Pilates Class: Valid for 4 weeks from the activation date.

• New Client 3 Class Trial Offer: Valid for 3 weeks from the activation date.

• 10 Session Block Program: Valid for 3 months from the activation date.

• Membership (6-Month contract): 12 classes per month or 8 classes per month. 

Forfeiture: When your class package or contract hits its expiration date, any unused group classes are automatically forfeited. We do not offer extensions or partial refunds for unused sessions, except in legal cases of long-term medical incapacity (see Section 6).

​4. Online Sign-Ups & Right of Withdrawal (Widerrufsrecht):

​For membership purchased online or via booking app, clients have a statutory 14-day right of withdrawal from the day of purchase.  

​If a client explicitly requests to begin using their membership within this 14-day window, they retain their right to cancel the remaining portion but must pay compensation for value (Wertersatz) for any classes already attended. The compensation for each consumed class fwill be calculated based on the standard single drop-in rate of the studio and deducted from the refund.

​5. Cancellation & Rescheduling

​Client Cancellations: Clients must cancel or reschedule their session at least 12 hours before their scheduled time to receive a class credit. Cancellations made less than 12 hours fbefore a session (late cancellations) or no-shows will be charged in full, and the class credit is forfeited.  

Late Cancellations & No-Shows for Memberships: Members holding an active membership contract who fail to cancel at least 12 hours before their scheduled reformer class, or who do not show up, will be subject to a €10 cancellation fee.

​Instructor Cancellations: Firebird Pilates reserves the right to cancel or reschedule sessions due to unforeseen circumstances, including instructor illness or emergency. In such cases, clients will be offered an alternative session or a full refund.  

​6. Mandatory Statutory Clauses & Memberships

​Extraordinary Termination (Außerordentliche Kündigung): The right of either party to terminate the contractual relationship immediately for good cause (wichtiger Grund, § 314 BGB) remains unaffected. For the client, this includes long-term severe illness making Pilates participation permanently impossible. Firebird Pilates may request a medical certificate (ärztliches Attest), but will not demand disclosure of the specific medical diagnosis.  

​Note on Relocation: In accordance with the Federal Court of Justice (BGH), a residential relocation to a different city does not automatically grant a legal right to early termination, unless the studio itself closes or permanently relocates.  

​Membership Terms (If applicable to 6-Month Contracts): * Notice Period: The maximum notice period required to cancel a 6-month contract at the end of its initial term is 1 month.  

​Automatic Renewal: Following the initial 6-month term, the contract will not renew for another fixed term. It will automatically convert into an indefinite, month-to-month timeline that the client can cancel at any time with a maximum of 1 month's notice (§ 309 Nr. 9 BGB).  

​7. Health, Safety & Liability Limitations

​Client Responsibility: You acknowledge that Pilates involves physical activity and confirm that you are fit to participate. It is your responsibility to inform Firebird Pilates of any medical conditions, injuries, or limitations before attending a session.  

​Liability Limitations (Haftungsbeschränkung): Firebird Pilates is fully liable for damages resulting from injury to life, body, or health caused by a breach of duty by Firebird Pilates, its legal representatives, or vicarious agents. Firebird Pilates is also fully liable for damages caused intentionally or through gross negligence.  

​For minor negligence (leichte Fahrlässigkeit), Firebird Pilates is only liable in the event of a breach of an essential contractual obligation (an obligation whose fulfillment is essential for the proper execution of the contract and on whose compliance the client regularly relies). In such cases, liability is limited to foreseeable damages typical for this type of contract. Liability for minor negligence is otherwise excluded. This applies equally to all in-person sessions and online/virtual classes.  

8. Privacy & Data Protection

​Firebird Pilates collects and stores client data in accordance with GDPR and German privacy laws. For more details, please see the Privacy Policy.

​9. Intellectual Property

​All content on the Firebird Pilates website, social media, and within sessions—including videos, exercises, and branding—is the intellectual property of Firebird Pilates. Clients may not copy, distribute, or reproduce any materials without prior written permission.  

​10. Changes to Terms & Conditions

​Firebird Pilates reserves the right to update these Terms at any time. Clients will be notified of significant changes in text form.
